no Joe, he didn't exploit anything, the rule said he could replace the ECU within the box and he did. What was he suppose to say ' it says I can replace it, but the true spirit of IT is reflash only so... I'm not going to do what the rule book says because I don't want to pervert the possible intention of the rule'

Joe traction control can be done with the open ignition and a stock ECU. Why not argue for points ignition only.
