It seems that you are implying that them running it for some years makes it legal. And that is not correct.
It had just never been protested, even years prior at the ARRC.

But, a backmarker would never see such a protest lodged against him, nobody's going to do that. That's the "culture" of the club Racing organism. In autocross, back in my day, the "culture" was different, and protests flew more regularly. We get what we sow.
